Welcome to the Habby And Lace online store. These Terms and Conditions (“Terms”) govern your access to and use of our website, products, and services. By browsing, registering, or placing an order on our site, you agree to be bound by these Terms, along with our related policies, including our:

2. Eligibility
To use our website and place orders, you must be:
- At least 18 years old, or supervised by a parent/guardian
- Legally capable of entering into binding agreements
3. Product Information & Pricing
We strive to ensure that product descriptions, images, and prices are accurate. However:
- Colour shades may vary slightly due to lighting, camera settings, and screen displays
- Textures and quality can only be fully appreciated in person — this is a limitation of digital shopping
- Prices are subject to change without notice
- Product availability is not guaranteed until payment is processed and confirmed
4. Cut Fabric and Non-Returnable Items
When you purchase fabric by the metre or request a custom cut, whether online, via email, WhatsApp, or in-store, you agree that the item is non-returnable and non-refundable once it has been cut to your requested length.
This is a standard industry practice and is aligned with Section 20(3)(a) of the South African Consumer Protection Act (CPA), which states that goods that are “disassembled, altered, or cannot be returned to the original state for resale” may be excluded from general return policies.
Please ensure that you are completely satisfied with your selection before confirming your order.
We cannot be held liable for minor variations in colour, pattern scale, texture, or feel — as these are natural limitations of digital product presentation.
Once fabric is cut for you, it cannot be resold, and therefore no returns, exchanges, or refunds will be accepted on these items unless the product is defective.
5. Stock Availability
We stock a vast catalogue of products across multiple platforms. While we do our best to ensure accurate inventory, occasionally, items may become unavailable due to high demand, system lags, or human error.
In the event that a product you ordered is out of stock, we will:
- Notify you promptly
- Offer the option to:
- Replace the item with an alternative
- Proceed with the rest of the order (if applicable)
- Cancel the order and receive a full refund for the unavailable item or entire order
6. Payment Gateways & Transaction Fees
All payments are processed securely via Shopify’s integrated payment gateways (such as PayFast or others).
If a customer places an order and then cancels it voluntarily before it is shipped, we reserve the right to deduct payment processing fees from the refund amount.
These transaction fees are charged to us per order and are non-refundable from the payment processor, and as such, are not recoverable when an order is canceled by the customer.
7. Orders & Payments
- All orders must be paid in full before being processed
- Confirmation is sent via email after successful checkout
- Invoices and proof of payment must match your order details
8. Shipping & Delivery
Please refer to our full Shipping Policy. Highlights:
- Delivery available throughout South Africa (excluding PO Boxes)
- Delivery fees are calculated at checkout
- Primary courier: Aramex (with alternatives where needed).
- You or a representative must be available to receive delivery
- Unsuccessful deliveries may incur additional charges
9. Returns & Refunds

- Cut fabrics, haberdashery items, and special orders are non-returnable
- Defective goods can be returned under the 6-month CPA warranty
- Proof of purchase is required
- Management reserves the right to assess eligibility
10. Order Collection
Orders selected for in-store collection must be picked up within 7 days. Late collections will incur:
- Daily storage fee of R50.00 (excl. VAT)
- Admin fee of R200.00 (excl. VAT)
- After 30 days, unclaimed orders may be canceled with applicable charges deducted

You may access, correct, or request deletion of your personal information at any time.
12. Promotions, Discounts & Vouchers
- Promo codes must be used before checkout
- Cannot be retroactively applied
- Cannot be combined with other discounts unless explicitly stated
13. Intellectual Property
All content on our website — including images, text, logos, and designs — is owned by Habby And Lace and may not be copied or reproduced without permission.
14. Limitation of Liability
We are not liable for:
- Indirect or consequential losses
- Delays caused by couriers or inventory inaccuracies
- Incorrect information provided by the customer
15. Changes to Terms
We reserve the right to update these Terms at any time. Changes will be posted on our website with the effective date.

16. Governing Law & Jurisdiction
These Terms and all transactions, interactions, and use of the Habby And Lace website are governed by the laws of the Republic of South Africa.
By using this website or engaging in any transaction with us, you agree that any legal matters, disputes, claims, or proceedings arising between you and Habby And Lace shall be subject to the exclusive jurisdiction of the courts of South Africa.
This applies regardless of your location or the location from which the order was placed. Our operations, customer service, payment processing, and fulfillment are all conducted within South Africa and are protected and regulated by South African consumer, privacy, and commercial laws.
